Permitted Development vs Planning Permission
In some cases, you may be able to build a garden annexe under Permitted Development rights, meaning you do not need to apply for planning permission. However, strict criteria must be met for this to apply:
The annexe must be considered an “incidental building” to your main house. This means it can’t be a completely self-contained residence with full living facilities if you’re claiming Permitted Development rights.
It must not exceed 2.5m in height if built within 2m of a boundary, and the total footprint and placement must adhere to outbuilding regulations.
The annexe should not be used as a separate dwelling. For example, a garden office with a kitchenette or a gym room is incidental, whereas a fully self-contained granny annexe often requires planning.
When Planning Permission is Required
If your annexe will be used as a full-time residence for a family member, or as a rental unit, planning permission is usually required. This is because it becomes an independent living space, and local councils treat this differently from a standard garden room.
